High-profile cases

2019 – Pseudo-science case (the so-called Teslia case). Register of court decisions: No. 757/287/17-ц. Pro bono representation of the defendant in a defamation lawsuit where the plaintiff claimed that the defendant had called him a pseudo-scholar. The court of trial (Pecherskyi District Court of Kyiv) partially granted the claim by declaring the information on the claimant being a pseudo-scholar as untrue, while refusing to award damages. The court of appeal reversed the decision of the court of trial and ruled to dismiss the claim in its entirety.

2021 – Medvedchuk versus Kipiani, publishing house VIVAT LLC, printing house UNISOFT LLC (the so-called Stus case). Register of court decisions: No. 753/12294/19. The defamation lawsuit was based on the individual phrases from the book by Kipiani “Vasyl Stus’s Case”, which was published on terms of the exclusive license by publishing house VIVAT. Participation in this case on the defendant, publishing house VIVAT’s side. Result: partial (by 5%) claim upholding. In fact, it had been the first case over the previous 15 years, where Medvedchuk’s defamation claim was not fully upheld, and Medvedchuk himself appeared the victim of the Barbara Streisand effect.
